The prices listed on the Store’s website for a given Product are gross prices given in Polish zloty and include VAT, but do not include the costs of Product Delivery and the selected payment method.

Transaction and Product Delivery costs are borne by the Customer.

The total order price, visible in the Cart area before placing the order and after selecting the method of Product Delivery and payment, includes the price for the ordered Products along with applicable taxes and all additional costs, in particular Delivery and transaction costs. The Customer agrees to receive invoices in electronic form.

The refund of payment by the Seller shall be made without undue delay, no later than within 14 days from the date the reason arises, in the event of:

  • withdrawal from the Agreement by the Consumer,

  • cancellation by the Customer of the order or part of the order paid for before execution,

  • acknowledgment by the Seller of a claim covered by a complaint, in whole or in part, on the basis of generally applicable laws.

The refund shall be made using the same payment method that was used by the Customer in the original transaction, unless the Customer agrees to a different method which does not incur any costs for them.

The Seller is not obliged to reimburse additional Product Delivery costs incurred by the Customer if the Customer chose a Product Delivery method other than the least expensive standard Delivery method offered by the Seller.

§7 Complaints and Warranties

Complaints may be submitted by letter or email to the postal or electronic address: butik HAWROT, ul. Kopernika 8/18, 00-367, Warsaw, store@hawrot.com
The complaint notification should include a description of the issue and the Customer's identifying information.

The Seller shall process complaints within 14 days from the date of submission. It is recommended that the content of the complaint include the Customer's Contact Details to facilitate a response and related correspondence.

If the complaint concerns a Product, in order for the Seller to consider the complaint, the Customer should deliver or send the complained Product to the address: butik HAWROT, ul. Kopernika 8/18, 00–367, Warsaw.

Complaints may be submitted under the warranty for defects in Products covered by the Sales Agreement and other Services.

If the Product has a defect, the Customer may request that the Product be replaced with one free from defects or that the defect be removed. The Seller is obliged to replace the defective Product with a defect-free one or remove the defect within a reasonable time without excessive inconvenience to the Customer.

The Seller may refuse to comply with the Customer's request if bringing the defective Product into conformity with the Agreement in the manner chosen by the Customer is impossible or, compared to the alternative method of achieving conformity with the Agreement, would incur excessive costs.

If the Customer is not a Consumer, the Seller may also refuse to replace the Product with a defect-free one or remove the defect if the cost of fulfilling this obligation exceeds the price of the sold Product.

If the Product has a defect, the Customer may submit a statement to reduce the price or withdraw from the Agreement, unless the Seller immediately and without excessive inconvenience to the Customer replaces the defective Product with one free from defects or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by the Seller, or the Seller has not fulfilled the obligation to replace the Product with a defect-free one or remove the defect. The Customer may not withdraw from the Agreement if the defect is insignificant.

The Consumer may, instead of the defect removal proposed by the Seller, demand that the Product be replaced with a defect-free one or, instead of replacement, demand defect removal, unless bringing the Product into conformity with the Agreement in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by the Seller. When assessing the excessiveness of costs, the value of a defect-free Product, the type and significance of the defect found, and the inconvenience that would be caused to the Consumer by another method of satisfaction are taken into account.

The reduced price referred to in items 7.10 and 7.11 above should be in such proportion to the price resulting from the Agreement as the value of the defective Product is to the value of a defect-free Product.

The Consumer has the possibility to use the following out-of-court complaint handling and redress methods:

  • submitting a request to the permanent consumer arbitration court operating at the Trade Inspection for resolution of a dispute arising from the concluded Sales Agreement,

  • submitting a request to initiate mediation proceedings to the Provincial Inspector of Trade Inspection for the amicable resolution of a dispute between the Consumer and the Seller,

  • using the assistance of a district or municipal consumer ombudsman or a social organization whose statutory tasks include consumer protection,

  • submitting a complaint via the EU online ODR platform, available at http://ec.europa.eu/consumers/odr/.

§8 Withdrawal from the Agreement / Returns

The Consumer may withdraw from the Agreement, including the Sales Agreement, within 14 days without giving any reason, subject to the provisions indicated in the withdrawal instruction attached to the Terms and Conditions and available on the Store’s website.

The right to withdraw from the Agreement does not apply to the Consumer in relation to the Agreement:

  • if the Seller has fully performed the service with the explicit consent of the Consumer, who was informed before the service began that, upon its full performance by the Seller, they would lose the right to withdraw from the Agreement,

  • for a NON-PREFABRICATED PRODUCT, PRODUCED ACCORDING TO THE CONSUMER'S SPECIFICATIONS OR SERVING TO SATISFY THEIR INDIVIDUAL NEEDS,

  • for a PERSONALIZED PRODUCT, MADE TO THE CUSTOMER'S INDIVIDUAL ORDER AND MEASUREMENTS,

  • for a PRODUCT THAT DETERIORATES QUICKLY OR HAS A SHORT SHELF LIFE,

  • for a PRODUCT DELIVERED IN SEALED PACKAGING THAT, AFTER OPENING, CANNOT BE RETURNED FOR HEALTH OR HYGIENE REASONS IF THE PACKAGING WAS OPENED AFTER DELIVERY,

  • for PRODUCTS THAT, DUE TO THEIR NATURE, BECOME INSEPARABLY MIXED WITH OTHER ITEMS AFTER DELIVERY,

  • when the SELLER DETERMINES THAT THE PRODUCT SUBJECT TO WITHDRAWAL SHOWS SIGNS OF USE OR DAMAGE CAUSED BY THE CUSTOMER,

  • PERSONALIZED PRODUCTS MADE TO THE CUSTOMER'S INDIVIDUAL ORDER ARE NOT SUBJECT TO EXCHANGE OR RETURN.

The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. The statement may be made using the form attached to the Terms and Conditions and available on the Store’s website.

If the Seller receives the Consumer’s withdrawal statement electronically, they will promptly send the Customer confirmation of receipt.

The Consumer is obliged to return the Product to the Seller or hand it over to a person authorized by the Seller immediately, but no later than 14 days from the day of withdrawal. Sending back the Product before the deadline is sufficient to meet the deadline. This provision does not apply if the Seller has offered to collect the Product themselves.

The Seller is obliged to collect the Product at their own cost if, due to its nature, the Product cannot be returned by standard postal means and if it was delivered to the Consumer at the place of residence at the time of the conclusion of the Sales Agreement.

The Consumer is responsible for any diminished value of the Product resulting from using it beyond what is necessary to establish its nature, features, and functioning.

In the case of withdrawal, the Agreement is considered not concluded. If the Consumer submits a withdrawal before the Seller accepts their offer, the offer ceases to be binding.

Information on the right of withdrawal is available in the withdrawal instruction attached to the Terms and Conditions.

Personalized products or those made to the consumer’s individual order are not eligible for return.

The Consumer may return the product within 14 days of receiving the shipment without giving any reason; after this period, the Seller reserves the right to refuse the return.

Only returning the products within 14 days of receiving the shipment is considered a valid withdrawal. Merely notifying the Seller of intent to return (via email or phone) without returning the products within that period is not legally effective. In such cases, the Seller reserves the right to refuse the return.

The Seller reserves the right to refuse the return of products that show signs of use.

After accepting the return, the Seller will refund the Consumer within 14 days of receiving the return shipment via bank transfer or the original payment method.

The Seller informs that fabric patterns shown in the online store photos may differ from the actual ones. This is due to each item being unique; the print design is dedicated to a specific piece, and its placement may change with subsequent pieces.
